The theory of unexpected material difficulties is regarded as one of the judicial theories found by the French state council.

if the contractor with the administration is subjected to exceptional and unexpected material difficulties and is against the willingness of the two parties and then lead to change of the economies of the contract, resulted to an additional cost and difficulty in carrying out the contract.

In this situation, the contractor has the right to a judicial request to financial re-balance of the contract and the court should give him a judgment of compensation to the complete damages.
