According to the general rules of civil law, the contract is concluded as soon as the offer is linked to the acceptance, if its place and reason are considered legal, without prejudice to the special conditions required by law for the conclusion of a section of contracts.

the concept of the electronic contract and the mechanism of its convening according to the Iraqi legislation and some other legislation, without entering into all the technical details of electronic transactions.

such as : E-mail, telex, telephone and web, through (offer and acceptance) : the offer and acceptance in the electronic contract do not differ from them in the ordinary contract except in terms of the means used to express the desire to contract by electronic means ; the electronic offer can be binding if it is associated with a term, as the offeror remains committed for the duration of the term, but there is a special case in which the electronic offer is binding, as if the offer remained displayed on the electronic page of the offeror, as for electronic acceptance, it is done by electronic means.
