Abstract EN

Crimes against humanity represent a shameful behavior that is conducted by man and that forms a focus-area for both judges and legislators.

Legislators propose and approve punitive texts while judges implement the penalty stated in such texts.

As crimes against humanity are the most severe crimes man can commit, the legislator's response to them is even more severe.

Crimes like premeditated murder, extermination, rape, sexual enslavement, forced prostitution, forced sterilization or forced pregnancy are all international crimes for which the UAE legislator has reserved special decrees.

According to these decrees, the convicted person faces the most severe punishments, i.e.

life sentence and life imprisonment, provided that such crimes are committed on wide-scale or in a systematic form of attack targeting civilians.

In addition, the legislator requires the perpetrator’s awareness of such attack to increases penalty.

The wisdom of the legislator in imposing the abovementioned punishment is reflected not only in these decrees, but also in all punitive laws, as such behaviors are brutal and reckless.

In addition, committing such crimes in a systematic and collective manner targeting civilians makes it worse in terms of conduct and consequence.

Worth noting, in this context, is that the principles of Human International Law and the provisions of international charters prohibit attacking civilians.
