Arabic Abstract

إن امتلاك المسكن في الوقت الحاضر قد يكون صعباً بالنسبة لكثير من الأفراد نظراً لضعف قوتهم الشرائية، لذلك سعت الدول إلى البحث عن حلول لمشكلة الإسكان، و من ضمن هذه الحلول القروض العقارية، فعقد القرض العقاري يمثل الأداة القانونية التي تنظم العلاقة بين المقترض (طالب التمويل) و بين المقرض (المؤسسة المالية التي تتولى عملية (الإقراض و بين أي أطراف أخرى تتدخل في هذه العلاقة، و توصلت الدراسة إلى أن التنظيم القانوني لعقد القرض العقاري يختلف حسب القوانين المنظمة له، حيث اختلفت القوانين محل المقارنة في ربط عقد القرض العقاري مع العقد الرئيس المراد تمويله، و اختلفت في تحديد النطاق الشخصي و الموضوعي للعقد و في الحماية القانونية المقررة للمقترض باعتباره الطرف الأضعف بالنسبة للمقرض من الناحية الاقتصادية و المعرفية، و اختلفت كذلك في تنظيمها للضمانات التي تشجع المقرض على منح القروض العقارية و تحمي من حالات عدم الوفاء أو العجز عن الوفاء، أما فيما يخص الأردن فلا يوجد قانون خاص ينظم المسائل المتعلقة بعقد القرض العقاري، لذلك كان المرجع للأحكام العامة في القانون المدني و قانون البنوك و تعليماته، حيث تختلف الضوابط و الشروط التي تحكم القروض العقارية من بنك لآخر.

وانتهت الدراسة بالتوصية على ضرورة التدخل التشريعي لإصدار قانون خاص للقرض العقاري في الأردن و الاستفادة من التنظيم القانوني لعقد القرض العقاري في القوانين محل المقارنة، و تظمينه بعض المبادئ الأساسية.

English Abstract

Owning a home now may be become difficult for many individuals due to their weak purchasing power.

Therefore, countries have sought to search for solutions to the housing problem, and among these solutions are real estate loans.

The real estate loan contract represents the legal tool that regulates the relationship between the borrower (requesting finance), and the lender (the financial institution that processes the lending process), and any other parties that intervene in this relationship, and the study concluded that the legal regulation of the real estate loan contract differs according to the laws governing it, Where the laws subject to comparison differed in linking the real estate loan contract with the main contract to be financed, they differed in defining the personal and objective scope of the contract and in the legal protection of the borrower as the weaker party from the lender in terms of economic and knowledge, and also differed in their regulation of guarantees that encourage the lender to grant real estate loans and protect against cases of non-fulfillment or inability to fulfillment.

As for Jordan, there is no law or special system that regulates matters related to the real estate loan contract.

Therefore, the reference was for the general provisions in the Civil Law and the Central Bank Law and its instructions, where the controls and conditions governing real estate loans differ from one bank to another, The study concluded and recommended the necessity of legislative intervention to issue a special law for real estate loans in Jordan and for the use of the legal regulation of the real estate loan contract in comparison laws, and including some certain basic principles.
