Arabic Abstract

تناولت هذه الدراسة موضوع الحماية المدنية لبيانات الأفراد الشخصية عبر شبكة الإنترنت في إطار مقارن بين القانون الأردني و العراقي مع الإشارة إلى بعض القوانين العربية من أجل توفير الحماية اللازمة لبيانات الأفراد الشخصية.

و قد تطرقت هذه الدراسة إلى البحث في ماهية البيانات الشخصية محل الحماية، و تبين من خلال البحث، أن البيانات الشخصية هي جميع البيانات المتعلقة بالشخص الطبيعي دون الشخص المعنوي، و هي تنقسم إلى نوعين من البيانات بعضها بيانات عادية، و بعضها ما يعتبر من البيانات الحساسة و التي يحظر معالجتها إلا بموافقة صاحبها، و يلاحظ عليها أنها جميعها تندرج تحت مظلة حرمة الحياة الخاصة، و التي هي من الحقوق الدستورية اللصيقة بالشخص باعتباره إنساناً يعيش داخل المجتمع.

و كما تناولت الدراسة الأنماط و المتمثلة بالصور و الوسائل المستخدمة في التعدي على هذه البيانات، و من أبرز صورها، مواقع التواصل الإجتماعي في حين كانت أبرز الوسائل المستخدمة في التعدي هي القرصنة الإلكترونية.

و هدفت الدراسة محاولة التعرّف على التنظيم القانوني الأمثل لحماية البيانات الشخصية للأفراد عبر شبكة الإنترنت في ظل هذه القوانين.

حيث توصلت الدراسة إلى مجموعة من النتائج أذكر منها : أن البيانات الشخصية للأفراد تعدّ من قبيل الحقوق الشخصية ؛ ذلك أن أساس الحماية القانونية لتلك البيانات، هو ما للإنسان من حق شخصي في حرمة حياته الخاصة، مما يوفر الحماية لهذا الحق في مواجهة الكافة.

كما أوصت الدراسة المشرع الأردني و كذلك المشرع العراقي أن يضعوا ضمانات قانونية و إجرائية فعالة من شأنها تفعيل الإلتزام بحماية البيانات الشخصية للأفراد، لضمان عدم فقدان هذه الحماية لفعاليتها أثناء عملية التطبيق العملي من قبل الجهات ذات الإختصاص.

English Abstract

The study aimed to address the issue of protecting individuals' personal data on the Internet in a comparative framework between Jordanian and Iraqi law, with reference to some Arab laws in order to provide the necessary protection for individuals' personal data.

This study addressed the nature of personal data subject to protection.

It turns out that personal data is all data relating to a natural person but not to a legal person, and it is divided into two types of data, some of which are ordinary data, and some of which are sensitive data that can only be processed with the consent of the owner.

It should be noted that they all fall under the umbrella of the sanctity of private life, which is one of the constitutional rights attached to the person as a human being living within community.

The study dealt with the patterns of infringement represented by images and the means used to infringe on this data, most notably social networking sites, as the most prominent means used in infringement was electronic piracy (Hacking).

Moreover, the study aimed to try to identify the optimal legal regulation for the protection of personal data of individuals via the Internet under these laws.

The results of the study showed that the personal data of individuals is one of the rights of the person, as the basis for the legal protection of such data is the person's personal right to the sanctity of his private life, which provides protection for this right in the face of all.

The study also recommended the Jordanian legislator as well as the Iraqi legislator to put in place effective legal and procedural guarantees that would activate the obligation to protect the personal data, to ensure that this protection does not lose its effectiveness during the practical application process by the competent authorities.
