Arabic Abstract

القانون إن الشهادة كانت ولا تزال من أهم وسائل الإثبات وأعظمها مكانة وأقدمها استعمالا، ولأهميتها تم استحداث طرق جديدة لأدائها وذلك تسهيلا على الأفراد المكلفين بها وأيضا لضمان سير الدعوى وعدم تعطيلها ، وكانت شهادة الشهود الالكترونية من أهم الوسائل المستحدثة في الأردني، حيث إن إجراء شهادة الشهود بالوسائل الالكترونية ساعد في تسريع الإجراءات في حال تعذر حضور الشاهد إلى المحكمة المختصة للإدلاء بشهادته ومكن الخصوم والمحكمة من استجوابه بشكل مشابه لاستجوابه بشكل مباشر وعن قرب، وعلى هذا الأساس تهدف هذه الدراسة إلى التعريف بالإثبات بشهادة الشهود الالكترونية ووضحت إجراءات أدائها الكترونيا، وبينت الطرق والوسائل التي أخذ بها المشرع الأردني، وفي نهاية الدراسة بينا الصعوبات التقنية والقانونية التي تواجهان الإثبات بشهادة الشهود إلكترونيا، واهتمت دراستنا بمعرفة موقف المشرع الأردني من الإثبات بشهادة الشهود الالكترونية وكيف عالجها، واتبعت الباحثة المنهج الوصفي والتحليلي والتطبيقي.

وقد توصلت الدراسة إلى عدة نتائج كان أهمها أن الصعوبات القانونية التي تفيد من اللجوء إلى شهادة الشهود الالكترونية تتأمل في تقييد أدائها عن طريق المحكمة الأقرب للشاهد وانعدام إمكانية أدائها عن طريق السفارة الأردنية مثلا، وذلك في حال كان الشاهد يقيم خارج البلاد، أو أدائها من داخل السجن بالنسبة للمكلف بالشهادة إن كان مسجوناً.

كما أوصت الدراسة ببعض التوصيات ومنها أنه يتوجب على المشرع الأردني حل مسألة تحديث خانة لإجراء المكالمات المصورة عبر الموقع الرسمي المخصص لخدمات المحاكم لتباشر إجراءات أداء شهادة الشهود الالكترونية وسماعها عبره دون الحاجة إلى اللجوء إلى المواقع والتطبيقات غير التابعة لوزارة العدل الأردنية، وإن كانت خاضعة لحماية تقنية عالية من المخربين والمتدخلين.

English Abstract

The testimony was and still one of the most important and oldest means of proof, therefore, for its importance, new methods of performance were developed in order to facilitate the conduct of the distute and also to ensure that the case is conducted and not disrupted, the electronic witness testimony was one of the most important means developed in the Jordanian law, as the conduct of witness testimony by electronic means helpedspeed up the proceedings if the witness could not come to the competent court to testify and enabled the adversaries and the court to question him similarly for direct and close interrogation, on this basis, this study aims to identify the evidence of electronic witness testimony and explained its performance procedures electronically, it also showed the methods and means taken by the Jordanian legislator, and at the end of the study weshowed the technical and legal difficulties faced by proof of electronic witness testimony, and our study was interested in knowing the position of the Jordanian legislator on the proof of electronic witness testimony and how he treated it, and the researcher followed the descriptive, analytical and applied approach.

The study reached a set of results, of which the most important was that the legal difficulties that restrict the use of electronic witness testimony are restricting itsperformance through the court closest to the testimony and the lack of possibility of performing it through the Jordanian Embassy, for example, if the witness lives outside the country, or performing it from within the prison for the imprisoned witness.

This study also recommended some recommendations, of which that the Jordanian legislator must resolve the issue of the testimony of electronic witnesses through a means of communication that is not directly affiliated with the Ministry of Justice, by updating a box to make video calls through the official website dedicated to court services, and to initiate the procedures for the performance of the testimony of electronic witnesses and take it through it without the need to resort to sites and applications that are not affiliated with the Jordanian Ministry of Justice, even if they are subject to high technical protection from saboteurs and interventionists.
