Arabic Abstract

حالة الطوارى حالة استثنائية فالأصل أن تعيش الدولة في حالة من الاستقرار تنظمها مجموعة من القواعد الدستورية و القانونية و استثناءً من هذا الاصل قد تتعرض الدولة إلى خطر يهدد أمنها و نظامها العام و لاستنفاذ أو عجز الأساليب العادية عن مواجهة ذلك الخطر، تضطر الدولة لوضع تشريعات استثنائية تمنح السلطة التنفيذية صلاحيات استثنائية.

إلا أن المشرع عندما يمنح الإدارة تلك الاختصاصات الواسعة لا يعني تركها حرة من دون قيد.

الغرض من هذه الدراسة هو بيان الضوابط و الشروط التي تقيد الإدارة في إعلان حالة الطوارئ و تنفيذها و توضيح الصلاحيات الاستثنائية التي تمنح للإدارة في ظل حالة الطوارئ و البحث في دور رقابة القضاء و البرلمان على إعلان و تنفيذ حالة الطوارئ.

و لتحقيق الهدف المنشود تعرضت الدراسة إلى بيان ماهية حالة الطوارئ من حيث مفهومها و انواعها و أساسها القانوني و بينت التنظيم القانوني لحالة الطوارئ في كل من الأردن والعراق.

كما حللت الدراسة الرقابة البرلمانية و القضائية على القرار الصادر بإعلان حالة الطوارئ و الإجراءات المتخذة في ظل حالة الطوارئ و من بين النتائج التي توصلت لها الدراسة هو أن الإدارة تبقى محددة بضوابط معينة عند ممارستها الصلاحيات الاستثنائية في حالة الطوارئ إذ يبقى مبدأ المشروعية قائماً و لكنه يتّسم في ظل حالة الطوارئ بالمرونة و تتسع دائرته لمواجهة الأخطار التي تواجه الدولة فنكون أمام ما يسمى بالمشروعية الاستثنائية أو إدارة الأزمات.

English Abstract

The state of emergency is an exceptional situation that cannot be faced through the constitutional and legal principles applicable in normal circumstances.

Such exceptional situation may negatively affect the security of the state and public order.

Due to the exhaustion or the failure of the regular rules to face the threat resulting from the state of emergency, the state will be compelled to enact exceptional legislations that grant the executive authority exceptional powers.

However, this does not mean that the administrative authority may exercise those exceptional powers without restriction.

This study aims at scrutinizing the conditions that restrict the exercise of the administrative authority in declaring and implementing a state of emergency.

It also clarifies the exceptional powers granted to the administration during the state of emergency.

It further examines the role of the judiciary and parliament in overseeing the declaration and implementation of the state of emergency.

In order to achieve the above-mentioned objectives, the study details the concept, types and legal basis of the state of emergency and analyzes the legal frameworks applicable in Iraq and Jordan to regulate the state of emergency.

The study also scrutinizes the parliamentary and judicial oversight on the decisions to declare the state of emergency and the measures taken in light of the state of emergency.

The study mainly concluded that the administration’s authority to exercise exceptional powers during the state of emergency remains restricted, as the principle of legality applies to the actions of the administration.

Nevertheless, due to the state of emergency, the principle of legality will be interpreted in a flexible manner to consider the eminent threats resulting from the state of emergency, which can be called exceptional legality or crisis management.
