Arabic Abstract

تتناول الدراسة مسألة الحصانات القضائية التي يتمتع بها المبعوث الدبلوماسي والتي وردة في اتفاقية فيينا للعلاقات الدبلوماسية حيث تم تقسيم الدراسة الى بابين باب يتعلق بالإطار النظري للحصانة القضائية للمبعوث الدبلوماسي وباب ثان يتظمن الجوانب العملية للحصانة القضائية للمبعوث الدبلوماسي ويحتوي على مدى ونطاق الحصانات القضائية التي يتمتع بها المبعوث الدبلوماسي.

وكان من أبرز نتائج البحث أن للحصانة القضائية حدود شخصية محددة وواضحة، وهنالك موضوعية وإجرائية ولكل منها نطاق مكاني وزمني من حيث الجرائم التي تشملها وتترتب عليها، بالإضافة إلى أنه تم فرض الحصانة القضائية لجميع القضاة بدون أي استثناء وهذا الأمر على اختلاف المحاكم التي يعملون بها وعلى اختلاف درجاتهم.

كذلك تشمل الحصانة القضائية جميع الجرائم على اختلافها سواء أكانت تتعلق بالوظيفة وغير المتعلقة بها وعلى اختلاف انواعها سواء أكانت جناية أو جنحة أو أي مخالفة.

إلى جانب أن سوء استعمال الحصانة القضائية من قبل المبعوثين الدبلوماسيين هذا الأمر قد نتج عنه العديد من الآثار التي قد أدت إلى جنب أنتباة العديد من المجموعات الدولية، ومن المحتمل أن تؤدي الحصانة القضائية في أغلب الأحيان إلى ضياع حقوق المتضررين في التعويض من جراء أفعال الممثلين الدبلوماسيين.

وكان من أهم مقترحات البحث أن يتم إعادة النظر نحو الاتفاقيات الدبلوماسية التي تنظم قانون العلاقات الدبلوماسية نتيجة تخلفها في مسايرة التطور الحضاري للدول في مجال العلاقات الدولية، خاصة إذا تعلق الأمر بحصانة بعثات دبلوماسية للدول المتقدمة، وأنه من الممكن للدول العربية أن تقوم أن بتبني نظام دبلوماسيا مشتركا يستمد قواعده ومقوماته من النظام العربي الإسلامي، بحيث يكون أكثر ملائمة وانسجاما ويكون له تأثير في تطوير القانون الدولي الدبلوماسي.

English Abstract

The study deals with the issue of the judicial immunities enjoyed by the diplomatic envoy, which was mentioned in the Vienna Convention on Diplomatic Relations, where the study was divided into two chapters, a chapter related to the theoretical framework of the judicial immunity of the diplomatic envoy, and a second chapter that includes the practical aspects of the judicial immunity of the diplomatic envoy and contains the extent and scope of the judicial immunities enjoyed by the envoy The diplomat.

One of the most prominent results of the research was that judicial immunity has specific and clear personal limits, and there is objective and procedural, and each of them has a spatial and temporal scope in terms of the crimes it includes and consequent upon, in addition to the fact that judicial immunity has been imposed for all judges without any exception and this matter depends on the different courts in which they work and on their different degrees.

Judicial immunity also includes all crimes of all kinds, whether they are related to the job or not, and of their different types, whether they are a felony, a misdemeanor or any violation.

In addition to the fact that the abuse of judicial immunity by diplomatic envoys, this matter has resulted in many effects that have attracted the attention of many international groups, and it is likely that judicial immunity will often lead to the loss of the rights of those affected to compensation as a result of the actions of diplomatic representatives.

One of the most important research proposals was to reconsider the diplomatic agreements that regulate the law of diplomatic relations as a result of their failure to keep pace with the civilized development of countries in the field of international relations, especially if it comes to the immunity of diplomatic missions to developed countries, and that it is possible for Arab countries to adopt a diplomatic system It derives its rules and components from the Arab-Islamic system, so that it is more appropriate and harmonious and has an impact on the development of international diplomatic law.
