The phenomenon of the spread of narcotics and psychotropic substances and addiction to them is one of the phenomena that does not recognize temporal and spatial boundaries, and its existence is not limited to a particular society or country due to its rapid spread due to the technological development witnessed by the worldAnd if this fight against this phenomenon falls within the scope of the internal law's jurisdiction, the international community has kept pace with the development that this phenomenon has known and the secrecy that characterizes the production and promotion process between different countries due to the development and diversity of those operations, as well as their great impact and considering them as transient crimes.

Borders, which required the conclusion of international agreements and treaties for the prevention and control of drugs, unifying efforts and keeping pace with national legislation to eliminate this phenomenon, which is increasing day by dayIn line with the fight against this phenomenon globally, the Algerian legislator has issued many laws, up to Law 18/04, which includes the prevention of narcotics and psychotropic substances and illicit trafficking in them.

The law included 39 articles listing all drug crimesThe Algerian legislator, in line with international legislation in general, has cited circumstances that may contribute to an exemption or mitigation of the penalty prescribed for the clemency of the accused through the Penal Code.
