This theory is hopeful that it will be guided by the establishment of a theory of professional responsibility, in which there is a tendency to redress the aggrieved with a compensation grant in cases where compensation is not possible.

The difficulty of the theory for the judiciary is to estimate the true value of the missed opportunity.
