Abstract EN

The contract of carriage of goods by sea is one of the most important contracts of carriage because of its international character and its contribution to the economic development of States.

Like other contracts, this contract creates legal obligations for its parties, especially for the carrier, as the most powerful party in this relationship.

The contractual relationship between the carrier and the shipper is established in the contracts for the carriage of goods by sea under the bill of lading, but it is different in its evidentiary case, whether against its parties or against third parties.

Through this study, we will highlight the role of the sea bill of lading in the proof and its viability vis-à-vis its parties and others
