International humanitarian law is a branch of public international law, Its provisions are directed to persons in the international community under the first common article of the four Geneva Conventions of 1949, which includes respect for and commitment to its provisions, The serious violations stipulated in the agreements set out in the article are considered to be the pillar on which this law is based.

Accordingly, the study focused on those grave violations, which are considered war crimes under Article 85, paragraph 5, of Additional Protocol I of 1977 annexed to the Geneva Conventions of 1949.

In relation to war crimes adopted under international criminal law, which fell under the exclusive criterion of the census , And the consequent civil liability of the state, in addition to the criminal liability of individuals belonging to states that violate these provisions.
