The placement under electronic surveillance as one of the new alternatives to the penalty of deprivation of liberty, adopted by the Algerian legislator in the law n ° 18-01 completing the law n ° 05-04, regulating the penitentiary organization and the reintegration of prisoners, similar to comparative legislation, by which the sentence is imposed outside the penitentiary institution in the event of a sentence of deprivation of liberty not exceeding 03 years, or when the remainder of the sentence has to undergo does not exceed this duration, by means of sophisticated means, to wear the condemned under an electronic bracelet, In order to monitor his movements and to compel him to comply with the conditions laid down by law, taking into account the professional activity of the convicted personand other licensed works, the decision on the situation regarding electronic surveillance and merger has entrusted to the judge of the apply penalties, it should be noted that the application of this system, despite its legitimacy, may affect the right to privacy of convicted persons, guaranteed by internationalconventions and all constitutions, including the Algerian constitution.
