Abstract EN

The Study dealt with the jurisdiction of International Security Council as well as its political competence.

The study divided in two sections, and each topic is divided in two parts.

The first section clarified the functional relationship between the International Security Council and the International Criminal Court, and overlap between policy and the judiciary in the powers of International Security Council.

In the second section, the Security Council’s authority to refer to the International Criminal Court was discussed, as well its power to suspend investigation and prosecution, and its impact on the principle of complementary.

Among the most important result of study; The Security Council’s assertions of the inherent jurisdiction of the International Criminal Court to interfere in the adaptation of legal facts that are at the heart of judicial work, which means a politicization of the judiciary.
