This article deals with the change in the level of presence of Italian elements in Tunisia during the colonial period: from an actual and distinguished presence to mere marginalized elements striving to seek refuge in Libya, especially after June 10, 1940, the date of the abolition of the protection authority in the work of the September 28, 1896 agreement.

accordingly, it was necessary to adopt a historical-legal approach in order to be able to understand how the conditions of the Italian community in Tunisia developed, especially during the period between 1943-1947, and to identify the nature of the departure of a significant number of them to Libya (the neighboring Italian colony): is it just an immigration process or displacement?
