A commercial mortgage is security for a commercial debt; Some consideration of the quality of the originator of the mortgage or the beneficiary of it, and whether he enjoys of a merchant adjective, or others, that is he acquires the commercial character, if it is decided to guarantee a debt arising from a commercial business among the contracting parties, this type of contract is considered one of the binding contracts for two parties, so that if it is validly concluded, it produces certain effects between the contracting parties.

It originates obligations and rights for both the mortgagor and the mortgagee, As well as in addition to its effects on others (right of advancing, follow up right, Imprisonment right ), so this study comes to examine the effects of this type of mortgages on the parties to the relationship.
