يعالج البحث موضوعا على درجة من الأهمية كونه يتركز حول محور تعاقدي حيوي تتأتى أهميته من الحاجة الملحة للدواء والمستلزمات الطبية لحياة الإنسان ضمان وتكامله الجسدي وضمان مستوى صحي ملائم ببعديه البدني والنفسي وهذا لا يتحقق إلا من خلال نظام قانوني تعاقدي ينتج تجهيز أجود أنواع الأدوية من حيث المنشأ وكفالة صلاحية الاستعمال وطريقة الحفظ والتسويق وإحاطة المستهلكين بجوانب المادة الدوائية.
إن فعالية الأحكام القانونية لعقود تجهيز الأدوية والأجهزة الطبية تقتضي التأسيس لأحكام متمايزة عن أحكام العقود الأخرى تقرر التزامات وحقوق الطرفين بما يراعي تعزيز سلطات جهات التعاقد والتي غالبا تكون مؤسسات عامة ومنحها صلاحيات فوق العادية في مجال تنفيذ وتعديل وإنهاء العقود الخاصة بهذا الموضوع، وفي الوقت نفسه عدم تحييد دور القطاع الخاص في تجهيز الأدوية والمستلزمات الطبية وفق محددات وشروط تضمن مواصفات الجودة والأمان في السلع المجهزة.
English Abstract
The research deals with a topic of great importance as it is centered around a vital contractual axis whose importance stems from the urgent need for medicine and medical supplies for human life to ensure its physical integrity and ensure an adequate level of health in its physical and psychological dimensions.
the origin, ensuring the validity of use, the method of preservation and marketing, and informing consumers of the aspects of the medicinal substance.
the effectiveness of the legal provisions for contracts for the supply of medicines and medical devices requires the establishment of provisions distinct from the provisions of other contracts that determine the obligations and rights of both parties, taking into account the strengthening of the powers of the contracting bodies, which are often public institutions, and granting them extraordinary powers in the field of implementing, amending and terminating contracts on this subject, and at the same time not neutralizing the role of the private sector in the supply of medicines and medical supplies in accordance with the limitations and conditions that guarantee the quality and safety specifications of the processed goods.
