Arabic Abstract

يعتبر الاستثمار بشكل عام نقطة اهتمام الكثير من الدراسات القانونية والاقتصادية، لما للاستثمار من دور كبير في مسألة تحقيق الرفاهية والتطور للدول، فكلما كانت المجالات التي يتم فيها الاستثمار يتم اختيارها بقرارات مدروسة دراسة جيدة، من قبل مجموعة من أهل الخبرة والاختصاص كلما كان التطور والتقدم والتنمية الاقتصادية سريعة وناجحة، حيث يعد الاستثمار في الوقت الحاضر العنصر الأساسي الذي تقوم عليه الخطط الاقتصادية الأساسية في اغلب البلدان، لإن التطور لا يقتصر على البيئة الاجتماعية والاقتصادية، بل لابد من خلق مناخ قانوني من خلال سن القوانين التي توفر بيئة استثمارية جاذبة.

لقد نص قانون الضمان الصحي العراقي رقم 22 لسنة 2020 على تحديد أوجه استثمار أموال الهيأة والمصادقة عليها وفقا للقانون.

إلا أن المشرع لم يحدد أوجه الاستثمار هذه، حيث أن نجاح الاستثمار في صندوق أموال الضمان الصحي لا يكون إلا أذا حقق عائدا كبيرا وبتكاليف قليلة، ومن جانب أخر يجب أن يحقق مصلحة هيئة الضمان الصحي ولا يتحقق ذلك إلا بتحديد أوجه استثمار أموال صندوق الضمان الصحي على وجه الدقة والعناية، لان الاستثمار في هذا الصندوق يحتاج إلى منظومة استثمارية متكاملة.

English Abstract

Investment in general is a point of interest for many legal and economic studies, because investment plays a major role in the issue of achieving prosperity and development for countries.

whereas, whenever the areas in which investment is made are chosen by well-thought-out decisions by a group of experienced and specialized, the development, progress and economic development will be faster and successful.

as investment at the present time is the main element on which the basic economic plans are based in most countries, because the development it is not limited to the social and economic environment, but a legal environment must be created through the enactment of laws that provide an attractive investment environment.

the Iraqi health guarantee law no.

22 of 2020 stipulates defining the aspects of investing the authority's funds and approving them in accordance with the law.

however, the legislator did not specify these aspects of investment, as the success of investing in the health guarantee fund is only if it achieves a large return at low costs, and on the other hand, it must achieve the interest of the health guarantee authority, and this can only be achieved by defining the aspects of investing the fund exactly and carefully, because investing in this fund needs an integrated investment system.
