Arabic Abstract

تكمن الفكرة القانونية للمادة (31) من دستور العراق لسنة 2005 في كفالة حق الرعاية الصحية بشقيها الوقائي والعلاجي وإلقاء هذا الالتزام الدستوري بجوانبه الإيجابية والسلبية على الدولة، لما يتمتع به هذا الحق من أهمية كبيرة في الوقت المعاصر؛ نتيجة التطور الصحي الكبير من جانب، ولازدياد ظهور الأمراض والأوبئة من جانب أخر، فعمد المؤسسون للإشارة إليه وإحالة تنظيمه المفصل للمشرعين في القوانين المتعلقة بالضمان الصحي.

أن التحقق من إثبات هذه الفكرة لا يتطلب البحث في قوانين سابقة على صدور الدستور، وكذلك سابقة على وجود وبلورة وتطور مفهوم الحق بالرعاية الصحية بمفهومه المعاصر، وهذا دفعنا لمناقشة هذه الفكرة مع قانون الضمان الصحي قم (22) لسنة 2020 النافذ، إذ يعد قانون الضمان أو التأمين الصحي في الأصل هو الوعاء الفاعل لانزال الحماية الدستورية لمظاهر حق الرعاية الصحية موضوع التطبيق، بدرجة اكبر من القوانين الأخرى ذات الصلة بالجوانب الصحية، ومن ثم يعد هذا القانون هو المسؤول الأول عن الضمان التشريعي والترجمة الدستورية لهذا الحق، إلا أن دور هذا القانون قد اتخذ منحى مغاير لفلسفته القائمة على "توفير الرعاية الصحية الشاملة للشخص المضمون" الواردة في لمادة (5) منه، إذ ركز على تأمين الجوانب العلاجية ولو بنحو نسبي دون التطرق تماما لتأمين الجوانب العلاجية، على الرغم من أن خدماته تقدم بمقابل مالي إلزامي لبعض الفئات.

English Abstract

The legal idea of article (31) of the constitution of Iraq of 2005 is to guarantee the right to health care, both preventive and curative, and to cast this constitutional obligation with its positive and negative aspects on the state, given the great importance of this right in the contemporary time.

as a result of the great health development on the one hand, and the increase in the emergence of diseases and epidemics on the other hand, the founders intended to refer to it and refer its detailed organization to legislators in laws related to health insurance.

the concept of the right to health care in its contemporary sense has developed, and this prompted us to discuss this idea with the Qom health insurance law (22) of 2020, which is in force, as the insurance or health insurance law is originally the effective container for the constitutional protection of the manifestations of the health care right subject to application, to a greater degree than other laws related to health aspects, and therefore this law is primarily responsible for the legislative guarantee and the constitutional translation of this right, but the role of this law has taken a different direction from its philosophy of “providing comprehensive health care for the insured person” contained in article (5) of it., as he focused on securing the therapeutic aspects, albeit in a relative manner, without addressing completely to secure the therapeutic aspects, despite the fact that his services are provided for a financial consideration that is obligatory for some groups.
