Arabic Abstract

ما بين أوضاع اقتصادية متدهورة و فقر، و جشع بعض الأشخاص من أجل الثراء السريع، و غياب الضمير الإنساني، و قصور الدور التشريعي، و عدم تناسب الأحكام الجنائية، و احتياج المرضي للشفاء بأي ثمن، تمخض عن كل ذلك جرائم مستحدثة على المجتمع المصري، و هي تجارة الأعضاء البشرية Human organ trafficking، جعلت البعض يضحي بأجزاء من جسده مقابل المال، و الأخر يسرق و يقتل من أجل نفس الهدف.

و بين حاجة الرغبة للشفاء و التخفيف من معاناة آلام، و حاجة آخرين في الحصول على جني المال في مقابل الاستغناء عن جزء حيوي من جسده، برزت ظاهرة الاتجار بالأعضاء البشرية التي لاقت رواجا كبيرا في الآونة الأخيرة.

و ظهر معها ما يسمي بالسوق السوداء لشراء هذه الأعضاء من خلال وسطاء، و تقدم آلاف من الأشخاص ممن يرغبون ببيع بعض أعضاء من أجسادهم و هم أحياء.

كما ظهر اتجاه أخر و هو عمليات خطف الأشخاص لا تهدف إلى الابتزاز و لكن من أجل اقتطاع جزء أو عضو من جسم الضحية المخطوف، لبيعة لشخص يحتاج هذا العضو لامتثاله للشفاء و بقاءه على قيد الحياة مقابل مبلغ من المال.

و هناك اتجاه ثالث لعملية الاتجار بالأعضاء البشرية و هي سرقة أعضاء الأشخاص المتوفين (الجثث)، من أجل نفس الغرض، و هو نزع بعض الأعضاء البشرية لاستغلالها و بيعها سواء من أجل استخدامها لعلاج شخص آخر أو من أجل بيعها لإجراء التجارب العلمية على تلك الأعضاء.

و لذلك فقد أضحت جرائم تجارة الأعضاء البشرية من الجرائم المنظمة التي باتت تهدد أمن و استقرار مصر، بل و دول الشرق الأوسط بأكملها.

لذلك فكانت هناك ضرورة حتمية للتصدي لهذا النوع من الجرائم الأكثر خطورة على الإطلاق في العصر الحديث، و بات علي أجهزة الأمن التعاون مع جهات إنفاذ القانون و مشاركة المجتمع الدولي بأكمله، لمواجهة تفشي سرطان تلك الجرائم الأكثر جسامة على مستقل الأمن و الاقتصاد داخل المجتمع الدولي عامة و على دولة مصر خاصة.

و تتكون خطة الدراسة من ثلاث مباحث : -المبحث الأول: الإطار القانوني لمواجهة جرائم الاتجار بالأعضاء البشرية.

المبحث الثاني : الجهود الدولية و الإقليمية و العربية و الوطنية لمواجهة جرائم الاتجار بالأعضاء البشرية.

المبحث الثالث : الجهود و الاستراتيجية الأمنية للتعاون في مواجهة جرائم الاتجار بالأعضاء البشرية.

و ينتهي البحث بخاتمة و بعض النتائج و التوصيات التي أظنها ستكون ضرورية و حتمية إن فعلت.

English Abstract

Between deteriorating economic conditions and poverty, the greed of some people for rapid affluence, the lack of human conscience, the lack of legislative role, the incompatibility of criminal provisions, and the need for patients to heal at all costs, all of which resulted in crimes that are new to Egyptian society, namely the trade of human organs trafficking, have made some sacrifice parts of his body for money, and others steal and kill for the same purpose.

between the desire to heal and alleviate the suffering of pain, and the need for others to make money in exchange for the dispensation of a vital part of his body, the phenomenon of trafficking in human organs has emerged, which has been very popular in recent times.

the so-called black market for the purchase of these organs through intermediaries has emerged, and thousands of people who want to sell some of their bodies live.

another trend has emerged : kidnappings aimed at extortion, but in order to cut off part or a member of the body of the kidnapped victim, to sell it to someone who needs that member to comply with the healing and survival of a sum of money.

the third trend of trafficking in human organs is the theft of the organs of deceased persons (corpses), for the same purpose, namely, the removal of some human organs for exploitation and sale, either for the treatment of another person or for the sale of them for scientific experiments on those organs.

the reform, the crimes of the trade of human organs have become organized crimes that threaten the security and stability of Egypt, and indeed the entire Middle East.

therefore, there was an imperative to address this type of the most serious crimes of all time in the modern era, and the security services must cooperate with law enforcement agencies and the participation of the entire international community, in order to confront the spread of the cancer of these most serious crimes on the independent security and economy within the international community in general and on the State of Egypt in particular.

the study plan consists of three investigations, the first : the legal framework for confronting the crimes of trafficking in human organs, the second : international, regional, Arab and national efforts to confront the crimes of trafficking in human organs, and finally the third : security efforts and strategy of cooperation in the face of the crimes of trafficking in human organs.

the research ends with its conclusion and some of the findings and recommendations that i think will be necessary and inevitable if it is done.
