Abstract EN

This study attempts to explore the basic obligations of the parties involved in international and non-international armed conflicts regarding the conduct of humanitarian assistance provided to the affected population.

this will be achieved by examining the nature of the principle of humanitarian assistance in international humanitarian law, and the conditions for its implementation in armed conflicts.

in particular, the article analyses the consent granted by the concerned parties and the need for humanitarian assistance and relief efforts based on the principles of humanity, neutrality, and impartiality, all principles which should avoid an aggressive behavior that would vitiate its legitimacy.

the study also sheds light on the obligations arising from the principle of humanitarian assistance, such as the obligation to allow and facilitate passage, and the obligation to respect and protect humanitarian workers.

the role of the UN security council in implementing humanitarian assistance efforts in various armed conflicts will also be addressed.
