Arabic Abstract

هدفت هذه الدراسة إلى إثراء كتب التربية الإسلامية للمرحلة الثانوية بقضايا فقه الأحوال الشخصية.

وتتلخص مشكلة الدراسة في الإجابة عن السؤال الرئيس التالي : - ما المادة الإثرائية لكتب التربية الإسلامية للمرحلة الثانوية بقضايا فقه الأحوال الشخصية؟ و يتفرع من السؤال الرئيس الأسئلة التالية : ما قضايا فقه الأحوال الشخصية التي يجب أن تتضمن كتب التربية الإسلامية للمرحلة الثانوية في فلسطين؟ ● ما مدى توافر قضايا فقه الأحوال الشخصية في كتب التربية الاسلامية المقررة على طلبة الصف الحادي عشر في فلسطين؟ ● ما مدى توافر قضايا فقه الأحوال الشخصية في كتب التربية الإسلامية المقررة على طلبة الصف الثاني عشر في فلسطين؟ واتبعت الباحثة في هذه الدراسة المنهج الوصفي التحليلي، حيث قامت بتحليل كتب التربية الإسلامية للمرحلة الثانوية (الصف الحادي عشر بجزئيه الأول والثاني) والصف الثاني عشر وعددها جميعاً ثلاثة كتب.

و لتحقيق أهداف الدراسة استخدمت الباحثة بطاقة تحليل محتوى لكتب التربية الإسلامية للصفين الحادي عشر و الثاني عشر و بناء قائمة بأهم قضايا فقه الأحوال الشخصية الواجب توافرها في كتب التربية الإسلامية للمرحلة الثانوية و قامت بتحليل الكتب في ضوء هذه القائمة، كما و استخدمت الباحثة المعالجات الإحصائية التالية التكرار و النسب المئوية.

و قد توصلت الدراسة إلى النتائج التالية : .

اشتقاق قائمة بقضايا فقه الأحوال الشخصية من الدراسات السابقة و الكتب المختصة و الرجوع إلى السادة المحكمين، حيث تكونت القائمة من (51) قضية موزعة على ثمانية مجالات : (أحكام النكاح، قضايا المهور، حقوق الزوجين، قضايا النفقات، أحكام الطلاق، أحكام العدة، قضايا الحضانة، أحكام الميراث).

ثم إثراء قضايا فقه الأحوال الشخصية التي حصلت على أدنى نسبة توافر عدد تحليل كتب التربية الإسلامية للمرحلة الثانوية وهي كالتالي :) التوكيل بالزواج، الكفاءة، ماهية المهر، وجوب المهر، لزوم المهر، حقوق الزوج، قوامة الزوج، ماهية العدة، وجوب العدة، عدة الطلاق، عدة الوفاة حضانة الأولاد، من حضانة الأولاد، موانع الحضانة، ماهية الميراث والتركة شروط الميراث استحقاق التركة الموانع من الإرث الإرث بالفرض، الإرث بالتعصيب، مسائل منوعة.( وفي نهاية الدراسة أوصت الباحثة بما يلي : ●.

أحد قائمة قضايا فقه الأحوال الشخصية التي توصلت إليها الباحثة بعين الاعتبار عند تطوير المناهج التعليمية وخاصة التربية الإسلامية.

العمل الجاد وتعزيز الثقافة القانونية لطلبة المرحلة الثانوية من خلال برامج هادفة.

● العمل على تطوير مناهج التربية الإسلامية لضمان التوزيع العادل والتوازن في نسب تضمين قضايا قانون الأحوال الشخصية في ضوء الدراسة.

English Abstract

This study aimed to enrich the books of Islamic education for the secondary stage with issues of jurisprudence of personal status.

The study’s problem is summarized in answering the following main question : What is the enrichment material of Islamic education books for the secondary stage with issues of jurisprudence of personal status? The following questions is derived from the main question : •What are the personal status jurisprudence issues that should include Islamiceducation books for high school in Palestine? •What is the extent of availability of personal jurisprudence cases in Islamic education books prescribed for eleventh graders in Palestine? •What is the extent of availability of personal jurisprudence cases in Islamic education books prescribed to twelfth grade students in Palestine? In this study, the researcher followed the descriptive analytical approach, as she analyzed the books of Islamic education for the secondary stage (the eleventh grade in its first and second parts) and the twelfth grade, all of which are three books.

To achieve the goals of the study, the researcher used a content analysis card for Islamic education books for the eleventh and twelfth grades and to build a list of the most important personal jurisprudence issues that must be available in the books of Islamic education for the secondary stage and she analyzed the books in the light of this list, and the researcher used the following statistical treatments: frequencies and percentages.

The study reached the following results : Deriving a list of personal status jurisprudence issues from previous studies and specialized books and referring to the arbitrators, as the list consisted of (51) cases distributed in eight areas: (marriage provisions, dowry cases, spouses ’rights, expenses issues, divorce rulings, several provisions, cases Custody, provisions of inheritance).

Then enrich the issues of personal jurisprudence that obtained the lowest availability when analyzing Islamic education books for the secondary stage, which are as follows: (Power of attorney for marriage, competence, dowry, obligatory dowry, need for dowry, husband’s rights, guardianship of the husband, what is the count, and the necessity of the count, Divorce count, death count, child custody, child custody age, contraindication barriers, what is inheritance, inheritance terms, maturity of the estate, barriers to inheritance, At the end of the study, the researcher recommended the following : •Taking the list of personal status jurisprudence issues that the researcher found into consideration when developing educational curricula, especially Islamic education.

•Work hard and promote the legal culture of secondary school students through targeted programs.

•Work on developing Islamic education curricula to ensure equitable distribution and balance in the proportions of including personal status law cases in the light of the study.
