أقر المشرع الجزائري مبدأ حرية أسعار السلع و الخدمات كأصل عام بموجب المادة 04 من الأمر رقم : 03-03 وفقا لقواعد المنافسة الحرة و النزيهة، إلا أن هذه الحرية تقيدها المادة 05 من نفس القانون و تمنح للدولة حق التدخل في تحديد بعض أسعار السلع و الخدمات الضرورية للحياة اليومية للمستهلك، و هذا تماشيا مع أوضاع معينة و باستعمال آليات محددة بموجب القانون.
Abstract EN
The Algerian legislator approved the principle of freedom of prices of goods and services as a public asset, under article 04 of ordinance n° 03 03 in accordance with the rules of free and fair competition.
however, this freedom is restricted by article 05 of the same law and grants the state the right to intervene in determining some prices of goods and services necessary for the daily life of the consumer.
this is in line with certain conditions and by using mechanisms specified by law.
