التجارب الطبية هي كل بحث أو اختبار يقع على الكائن البشري في ضوء تطور المعطيات البيولوجية أو الطبية و هي نوعان تجارب طبية علاجية غرضها تحقيق شفاء المريض، و التجارب علمية غرضها تحقيق شفاء المريض، و التجارب علمية غرضها اكتساب معارف جديدة دون أن تكون هناك مصلحة مباشرة للخاضع لها، و لقد أثارت التجارب الطبية إشكالية الموازنة بين متطلبات و لتحقيق ذلك قامت معظم، تحقيق التقدم العلمي و بين حق الفرد في سلامة جسده و الحفاظ على كرامته الإنسانية لغرض إضفاء المشروعية عليها، و ذلك من خلال وضع شروط، الدول بسن قوانين من اجل تنظيم التجارب الطبية و أجراءها، و ترتيب المسؤولية الجزائية على كل من يخافها.
Abstract EN
Medical experiments are research or tests done on the human body in light of the development of biological or medical data, and they are two types : therapeutic medical experiments aimed at achieving patient healing, and scientific medical experiments whose purpose is to acquire new knowledge without the direct interest of those who are subject to it, medical experiments have raised the problem of balancing the demands of achieving scientific progress with the individual’s right to the integrity of his body and the preservation of his human dignity.
for that, most states have passed laws to regulate medical experiments in order to legitimize them by setting the conditions for their conduct and by organizing the criminal responsibility of those who violate them.

Les expériences médicales sont des recherches ou des tests effectués sur le corps humain à la lumière du développement de données biologiques ou médicales, et ce sont deux types: les expériences médicales thérapeutiques visant à parvenir à la guérison des patients, et les expériences médicales scientifiques dont le but est d’acquérir de nouvelles connaissances sans l’intérêt direct de ceux qui y sont soumis, les expériences médicales ont soulevé le problème de l’équilibre entre les exigences de la réalisation du progrès scientifique et le droit de l’individu à l’intégrité de son corps et la préservation de sa dignité humaine.
Pour cela, la plupart des États ont adopté des lois pour réglementer les experiences médicales afin de les légitimer en fixant les conditions de leur conduite et en organisant la responsabilité pénale de ceux qui les violent.
