تعتبر الملكية العقارية وما يتفرع عنها من حقوق عينية من أهم الثروات التي تساهم في تطوير المجتمعات، لما لها من أهمية على مختلف الأصعدة، فبناء على تنظيم وتوجيه الاستثمار العقاري تتحدد الاتساعات الاقتصادية للدولة بمختلف صورها الصناعية والفلاحية والعمرانية، لكن بالمقابل ونظرا لهذه الأهمية للعقار فإن المنازعات بشأنه تكثر وتتشعب، مما يجعل من مسألة تحديد الجهة المختصة بنظرها أمرا صعبا، لاسيما بعد تبني المشرع الجزائري لمبدأ ازدواجية القضاء، حيث تقتسم جهات القضاء العادي مع جهات القضاء الإداري نظر المنازعات العقارية-التي من بينها منازعات الترقية العقارية-ويتحدد اختصاص كل جهة بناء على معايير معينة يتم توضيحها في هذا المقال

Real-estate and legal-interest are considered one of the most important resources that contribute in the development of societies.
based on the way they are organized and invested out, it is possible to define the various industrials, agricultural and urban economic opportunities that open up to the state.
however, the duality of the Algerian juridical system: ordinary and administrative courts makes disputes over it frequent and complex, identifying the rightful court to see through the matter is difficult, real-estate-promotion disputes, for example.
thus, is requires defined criteria to identify the legality of each court, as described in this article.
