Abstract EN

Nowadays, illegal immigration has become a widespread phenomenon among Algerian youth, and it is not only an illegal act, but has been putting the lives of these immigrants in danger and causing tragedies for their families.

moreover, it is no longer specific to the male category only, but rather women have become competing with men for the death boat.

to confront the spread of this phenomenon, it was necessary to combine efforts in order to reduce it and protect our youth, whom are the basis on which society is built and developed.

hence it was requisite for the legislator to intervene by setting up legal mechanisms to combat this phenomenon.

one of them was the amendment of the penal code by law 09-01.

the importance of this research appears in its connection with protecting the security and stability of the homeland on the one hand, and protecting the Algerian youth from risking their lives on the other hand.

as this study aims to clarify the actions that fall within the scope of illegal immigration, the reasons that motivate young people to do so, and the effectiveness of the mechanisms established by the legislator in law 09-01, to limit its spread.
