Through this article we are trying to clarify the legal approach to the declaration of non interference or what is known in the concurrence jurisprudence as «negative certificate» as a protective document when it comes to agreements or position of market dominance without the rest of the practices restricting concurrence, in accordance with the provision of excutive decree No.

05-175 dated may 12, 2005 specifying the modlities of declaring non interference in relation to agreements and the position of market dominance that came in implimentation of the provisions of the article 8 of ordinance n 03 03 of July 19, 2003 relating to the amended and supplemented competition law.
