تشكل الجريمة الجمركية واحدة من الجرائم التي سعى المشرع الجزائري لقمعها عن طريق سياسة جنائية خاصة ومتميزة مقارنة مع السياسة الجنائية التقليدية، وتترجم السياسة المنتهجة من طرف المشرع الجزائري من حيث التجريم في تبني إجراء التفويض التشريعي واعتبار الجريمة الجمركية من قبيل جرائم الخطر لا الضرر، ناهيك عن افتراض القصد الجنائي.
وزيادة عن ذاتية سياسة التجريم فإن سياسة العقاب في الجريمة الجمركية هي الأخرى تعرف نوعا من الذاتية والتي انعكست لا محالة على المسؤولية الجنائية من خلال توسيع نطاق المسائلين جنائيا، وكل هذا من أجل الوصول لفكرة قمع مرتكب الجريمة الجريمة الجمركية.

The customs crime is one of the crimes that the Algerian legislator sought to suppress through a special and distinct criminal policy compared to the traditional criminal policy.

in addition to the subjectivity of the policy of criminalization, the policy of punishment in the customs crime is also known as a kind of subjectivity, which is inevitably reflected on criminal responsibility by expanding the scope of criminal matters, and all this in order to reach the idea of suppressing the perpetrator of the customs crime.
