Abstract EN

This research contains some theorizing of the term jurisprudential guidance in the Maliki school and a statement of some of its meanings and objectives according to Ibn Battal in financial transactions, with a mention of some examples and models on that from his author on the explanation of Sahih al-Bukhari.

There is no saying, fatwa, or ijtihad that does not have a basis and a document in the religion to which it is referred to upon verification, except that in many cases the mujtahid does not state his opinion or basis in that, and perhaps this is what motivates many imitators from seeking evidence and inference because the fatwa is issued by someone He trusts in his knowledge and piety.

The jurisprudential guidance came based on this foregoing, thus making Islamic jurisprudence comprehensiveness and fertility in renewal.
