Abstract EN

In times of armed conflicts, cultural property is often subjected to destruction and looting, which is described as war crimes, crimes against humanity or even a genocide.

from this point of view, this study aims to highlight the role of the ad hoc tribunals in protecting cultural property through the judicial precedents left by them, in order to be able to know the extent of their contribution to the protection of this property.

the study concluded that the judicial precedents are a strong impetus in the field of confirming, interpreting and developing customary international rules and the convention on the protection of cultural property, which constituted a reference on which the ICC worked in the Al-Mahdi case.
