Abstract EN

This study addressed Insolvency Declaration Request "problems and solutions ”Study in the Jordanian insolvency law No.

21 of 2018 initiating of applying the application until issuing a decision by the competent court to declare the insolvency, the Jordanian insolvency law confines the right of insolvency Declaration to the debtor, creditor, and companies' controller, contrary to what was applicable in bankruptcy application in accordance with the provisions of the Jordanian commercial Law, which was grant the right to the debtor and creditor، Court, and Public Prosecution bankruptcy request.

The problem of this study is formed on insolvency request, its procedures, steps, and the conditions of Insolvency law to judgment of debtor insolvency.

This study reached to various findings and recommendations, one of the most important result that confine the right of insolvency declaration for the debtor, creditor and companies' controller, and one of the most important recommendation is granting the Judiciary the power and authority to declare the insolvency of debtor by himself and not making this exclusively for debtor, creditor and companies controller.
