Arabic Abstract

للفقه الإسلامي أهمية كبيرة في صياغة المواد القانونية الخاصة بالأحوال الشخصية، فهو يتسم بالمرونة التيتجعله واقعيا شاملا لجميع جوانب الحياة، و هذه المرونة لا تمس الثوابت التي جاء بها الإسلام و المنصوص عليهافي القرآن الكريم و السنة النبوية، و إنما تدخل في إطار المتغيرات و المستجدات التي تظهر خلال مراحل الحياةالمختلفة، و مرونة الفقه الإسلامي تجعله ذو قدرة واضحة على مواكبة كل جديد يطرأ على واقع الناس في مختلفمناحي حياتهم السياسية و الاقتصادية و الاجتماعية.

البحث يتناول تحديات التجديد في مباحث الأحوال الشخصية الناجمة عن التقنين المعاصر الذي يعد أحد صورالتجديد الفقهي، و هو تجديد يقوم على الصياغة القانونية و التأليف و الشرح، و الاستفادة من جميع المذاهبالفقهية في التقنين المعاصر، ثم يتطرق البحث إلى أهم آليات العلاج لمواجهة هذه التحديات من خلال القواعدالضابطة للتجديد.

English Abstract

Islamic jurisprudence has great importance in drafting legal articles relatedto personal status, as it is characterized by flexibility that makes it realistic andcomprehensive to all aspects of life, and this flexibility does not affect the constantsthat Islam came and stipulated in the Holy Qur'an and the Prophet's Sunnah, butrather it falls within the framework of the changes and developments that appearduring The different stages of life, and the flexibility of Islamic jurisprudence, makeit a clear ability to keep abreast of all new developments in the reality of people invarious aspects of their political, economic and social life.

The research deals with the challenges of renewal in matters of personal statusresulting from contemporary legalization, which is one of the forms of jurisprudentialrenewal, which is a renewal based on legal drafting, authorship, and explanation, andmaking use of all jurisprudential schools of thought in contemporary legalization, then the research deals with the most important treatment mechanisms to facethese challenges through the rules Controls for renewal.
