Arabic Abstract

عني هذا البحث بدراسة موضوع الدعوة إلي حداثة الفقه الإسلامي وكيفية التصدي لها و هو من الموضوعاتالتي تمثل تحديا للشريعة الإسلامية بصفة عامة و للفقه الإسلامي بصفة خاصة لما تشتمل عليه هذه الدعوة منالثورة علي الأحكام الفقهية و إخضاعها للعقل و العلم ولغة العصر بلا ضوابط و قيود الأمر الذي يؤدي إلي تغييرالثوابت و تبديلها و إلغاء و تشويه و تبديد الفقه الإسلامي.

وقد سار هذا البحث علي خطة مقسمة إلي مبحثين و خاتمة و فهرس للمراجع، تعرضت في أهمية هذا البحث و إشكاليته و خطته، وفي المبحث الأول تعرضت لمفهوم حداثة الفقه الإسلامي، و تاريخ نشأةالدعوة إليها، و أسباب ظهور هذه الدعوة و خطورتها علي الفقه الإسلامي، وفي المبحث الثاني تناولت منهجالحداثيين في الدعوة إلي حداثة الفقه الإسلامي، وكيفية مواجهة هذا التحدي، و ختمت البحث بخاتمة فصلتفيها أهم النتائج و التوصيات التي توصلت إليها.

English Abstract

This research studies the subject of the call to the modernity of Islamic jurisprudenceand how to confront it.

It is one of the topics that represent a challenge to Islamiclaw in general and Islamic jurisprudence in particular because this call includesrevolution on jurisprudential rulings and subjecting them to reason، science andthe language of the age without restrictions and restrictions، which leads to changeThe constants and their replacement، and the abolition and distortion and dispel theIslamic jurisprudence.

This research is divided into an introduction، two articles، conclusion، and anindex of references.

The introduction deals with the importance of research and what it deals with andits plan.

The first topic deals with the concept of modernity in Islamic jurisprudence، thehistory of the origin of the call to it، the reasons for the emergence of this call and itsdanger to Islamic jurisprudence.

The second topic deals with the modernists 'approach in calling for the modernityof Islamic jurisprudence، and how to face this challenge.

The conclusion contains the most important search results.
