Arabic Abstract

الحمد لله رب العالمين، و الصلاة و السلام على أشرف المرسلين سيدنا محمد، و على آله و صحبه و سلم أما بعد.

فهذا بحث توخيت الاختصار فيه قدر الإمكان، يعالج البحث قضية من أهم و أخطر القضايا في المجتمع، ألا وهي قضية اثبات النسب و نفيه كونها تتعلق بأعراض الناس، التي هي من الضروريات الخمسة التي أكدتالشريعة على حفظها، ذكرت فيه طرق اثبات النسب و نفية، و مدى تأثير اكتشاف البصمة الوراثية أو الحمضعلى هذه الطرق، و بينت فيه الطرق التي لا تقف أمامها البصمة الوراثية كونها ثابتة بالكتاب، )DNA( النوويوالطرق التي تكون البصمة الوراثية عاضدة و ساندة لها، و الطرق التي لا يعمل بها في ظل اكتشاف البصمةالوراثية، وفي نهاية البحث عالجت مشكلة اجتماعية ازدادت في ظل المكتشفات الحديثة - كالشبكة العنكبوتيةووسائل التواصل الاجتماعي - هذه المشكلة تمثلت في ازدياد أعداد الاطفال التي تلقى في قارعة )internet(الطريق، و على أبواب المساجد، وغيرها من الأماكن حتى غصت بهم دور الأيتام و الملاجئ، فقد رجحت فقهياعاضدا ما ذهبت اليه بجملة )DNA( أنه يمكن أن ينسبوا الى آبائهم الحقيقين عند عدم الفراش بمساعدة تحليلمن الأدلة الفقهية و من ثم ختمت البحث بخاتمة تضمنت أهم الاستنتاجات التي خرجت بها من بحثي هذا.

لا إله إلا أنت سبحانك، إني كنت من الظالمين، و الحمد لله رب العالمين، و صلى الله تعالى على نبينا محمد و علىآله و صحبه و سلم.

English Abstract

Praise be to Allah، Lord of the Worlds، and peace and blessings be upon the most honorablemessengers، our Master Muhammad، and upon his family and companions.

، Eitherafter.

This research was intended to be as short as possible، and it deals with one of the mostimportant and dangerous issues in society، namely the issue of establishing lineage anddenying it as it relates to people's symptoms.

، Which are among the five necessities thatthe Islamic Law has emphasized preserving، in which I mentioned methods of establishinglineage and negation، and the extent of the impact of discovering the genetic fingerprint orDNA On these، and in it it showed the ways in which the genetic fingerprint does not standbefore it is fixed in the book، the ways in which the genetic footprint supports it، and themethods that are not used in light of the discovery of the genetic fingerprint، And، at theend of the research، she addressed a social problem that increased in light of modern discoveries- such as the internet and social media - which were represented by the increasein the number of children who were thrown on the streets and at the doors of mosques andother places until orphanages and shelters filled them.

I juridically suggested that theycould attribute to their real parents when they were not in bed with the help of DNA analysis، backing up what I went to with a set of jurisprudential evidence، and then I concludedthe research with a conclusion that included the most important conclusions I came out ofthis research.

There is no god but You، Glory be to You، for I was one of the oppressors، and praise beto Allah، Lord of the worlds، and may Allah Almighty bless our Prophet Muhammad andhis family and companions and grant them peace.
