من الموضوعات التي حامت حوله الشبهة)بيع الرصيد بالآجل(الممثل ببطاقات شاع التعامل بها بعد ظهورخدمة الهاتف النقال، و ظهور كارتات الشحن التي توسع سوقها بشكل كبير و كثر الوكلاء لها و أصبحت مما لايستغنى عنها و لا يمكن أن يقف تداولها؛ لأنها صارت من الحاجيات للتواصل و تيسير الاعمال بمختلف اشكالهاوانواعها.

فأقبل الكثير من المستهلكين على شراء أعداد كثيرة من هذه الكارتات بالسعر الآجل، ثم بيعها بالسعرالعاجل لغرض الحصول على المال ثم شابت هذه التعاملات شبه كثيرة من الاستغلال و التحايل و الخداع الذيأضر بالناس و أحدث مشكلات مجتمعية و خصومات، بسبب الجشع و الطمع في بيع هذه الكارتات، فأصبحمالك المال يشتريها بالنقد و يبيعها بالآجل مع تحميل السعر مالا تحتمله السلعة مستغلا في ذلك حاجة المحتاجينولهفة المعوزين إلى المال، و عند مجيء وقت السداد تحدث مشاكل و اتهامات و اعتداءات تصل الى حد الجريمة بعدأن يصحو المشتري بالآجل من غفلته و يعرف حجم ما وقع عليه من استغلال و تحميل للسلعة بما لا يتلاءم معالأجل.

و من هذه المشكلات: تحميل السعر بالآجل اكثر مما تحتمله السلعة، أو أن تعطي الجهة البائعة النقود للمقترضفيذهب و يشتري الكارتات نقدا، و يخبر الجهة البائعة انه اشترى هذه الكارتات بكذا فيقول له بعتك إياها دينابكذا، فيرجع الشخص المقترض الذي اشترى، فيبيع هذه الكارتات على المكتب نفسه، أو على مكتب آخرفيحولها نقودا، و لا يخفي ما في هذه التعاملات من حيل ربوية، فهي تشبه الى حد كبير ربا النسيئة و تنطبق عليهامواصفات بيع العينة، فإذن لا بد من الرجوع إلى رأي الشريعة بصورة عامة و الرجوع الى مقاصد الشريعة بصورةخاصة؛ لدراسة هذه المعاملة و بيان حكمها و هو ما سنتناوله في هذا البحث الموسوم: (أثر مقاصد الشريعة فيكشف مخالفات البيع بالآجل لكارتات شحن الهواتف النقالة).

English Abstract

Among the issues around which the suspicion has been raised (selling crediton credit) represented by cards that have become popular after the emergenceof the mobile phone service, and the emergence of shipping cards that haveexpanded their market greatly and have many agents for them and have becomeindispensable and cannot stop circulation; Because it has become one of the needsfor communication and facilitation of various forms and types of work.

So many consumers decided to buy many numbers of these cards at the forwardrate, then sell them at the urgent price for the purpose of obtaining money, thenthese transactions were marred by almost a lot of exploitation, fraud and deceptionthat harmed people and caused societal problems and discounts, due to greed andgreed in selling these cards, so he became the owner Money buys it for cash andsells it on credit with charging the price of money that the commodity cannot afford, exploiting the need of the needy and the eagerness of the needy for money, andwhen the time for payment comes, problems, accusations and assaults occur thatreach the level of crime after the buyer wakes up on the future from his negligenceand knows the size of the exploitation and loading of the commodity by what Itdoes not fit the term.

Among these problems: charging the price on credit more than the commoditycan bear, or for the seller to give the money to the borrower, so he goes and buysthe cards for cash, and he tells the seller that he bought these cards in this wayand he tells him that I sold them to you as such, then the borrower who bought itreturns, then sells these cards to the office The same, or another office that turns itinto cash, and the usurious tricks in these dealings are not hidden, as they are verysimilar to the usury of a woman and the specifications of the sample sale apply tothem.

To study this transaction and explain its ruling, which is what we will dealwith in this research marked: (The effect of the purposes of Sharia in detectingviolations of the deferred sale of mobile phone charging cards).
