Arabic Abstract

و هو من الموضوعات التي تمثل » التأصيل الفقهي الخاطئ للنوازل و المستجدات « يعني هذا البحث بدراسة موضوعتحديا للشريعة الإسلامية بصفة عامة و الفقه الإسلامي بصفة خاصة؛ لما له من أهمية كبرى، و ضرورة بالغة تمس و اقعالحياة المعاصرة، و لا ريب في أن التأصيل الفقهي الخاطئ يؤدي بدوره إلى تغيير الأحكام الفقهية و إخضاعها للعقلوالعلم ولغة العصر بلا ضوابط و لا قيود.

وقد سار هذا البحث علي خطة مقسمة إلى و تمهيد، و أربعة مباحث، و خاتمة، و فهرس للمراجع، تعرضتفي أهمية هذه الدراسة، و إشكاليتها، و منهج البحث و خطته، وفي التمهيد تعرضت لمفهوم التأصيل الفقهي، و النوازل و المستجدات، وفي المبحث الأول: تحدثت عن نشأة مصطلح التأصيل الفقهي، وفي المبحث الثاني: تحدثت عنأسباب ظهور التأصيل الفقهي الخاطئ، وفي المبحث الثالث: ذكرت نماذج للتأصيل الفقهي الخاطئ، وفي المبحث الرابع: تعرضت لأهم سبل العلاج والوقاية من التأصيل الفقهي الخاطئ، ثم ختمت البحث بخاتمة أودعت فيها أهم النتائجوالتوصيات.

English Abstract

This research deals with “The wrong doctrinal details of calamities anddevelopments.

” It is one of the topics that represent a challenge to Islamic lawin general and Islamic jurisprudence in particular.

This is because of its greatimportance، and a great necessity that touches the reality of contemporary life.

There is no doubt that the wrong doctrinal rationale leads in turn to changing thejurisprudential rulings and submitting them to reason، science and the language ofthe age without restrictions or restrictions.

This research is divided into an introduction، preface، four sections، a conclusionand an index of references.

The introduction deals with the importance of this topic، the researchmethodology and its plan.

preface deals with the concept of doctrinal rooting، calamities and developments.

The first topic: deals with the genesis of the term doctrinal rootingThe second topic: It deals with the reasons for the emergence of the wrongdoctrinal rooting.

The third topic: deals with examples of faulty jurisprudential rationale.

The fourth topic: It deals with the most important means of solutions andprevention of wrong doctrinal rooting.

Conclusion: It contains the most important search results.
