Arabic Abstract

تهدف هذه الدراسة إلى إبراز أهم المستجدات المالية المعاصرة التي تواجه الفقهاء اليوم، و بيان أثر مقاصدالشريعة الإسلامية في علاجها؛ وذلك بالاستعانة بالمنهج الوصفي و التحليلي في عرض أبرز هذه المستجدات، و مناقشة أثر توظيف مقاصد التصرفات المالية في التصدي لها.

وقد خلصت الدراسة إلى أن المقاصد الشرعية للأموال لها أثر كبير في علاج هذه المستجدات المتمثلة فيمختلف المعاملات المالية التي أفرزتها الهندسة المالية التقليدية و الاقتصاد الرقمي و التكنولوجيا المالية؛ و ذلكبتوظيفها وفق مراحل، بدءا بالتثبت من حصول المقاصد الشرعية في هذه المعاملات، ثم التحقق من مآلاتها، و إذا تعذر ذلك وجب البحث عن مخارج فقهية لها، على أن تكون مشروعة الوسائل و المقاصد.

English Abstract

This present study is intended to highlight the main contemporary financialtrends facing Sharia jurists, and indicate the impact of Sharia intends inaddressing them, by relying on the descriptive and analytical approach indescribing these main trends and discussing the impact of using the financialtransaction intends in dealing with them.

this study found that the Sharia intends have a significant impact inaddressing of these Various financial transactions trends produced by financialengineering, Digital economy and Fintech, by including them in specificstages; starting with the verification of Sharia intends in these transactions, then cheking their goes, but Where it is not possible, there must be a searchfor islamic jurisprudence exits with legal tools and intends.
