الاصل ان التشريع من اختصاص السلطة التشريعية و يناط تنفيذه بالسلطة التنفيذية غير ان مقتضيات التعاون بين السلطتين دفعت المؤسس الدستوري الى اعطاء السلطة التنفيذية امكانية التدخل في المجال التشريعي في حالتين.
الأولى.
تشترك فيها السلطة التنفيذية مع السلطة التشريعية في الاختصاص التشريعي من خلال اعطاء رئيس الجمهورية حق الاعتراض على القوانين و حق اصدارها.
الثانية.
تحل فيها السلطة التنفيذية محل السلطة التشريعية في سن التشريع من خلال منح رئيس الجمهورية صلاحية التشريع بالأوامر.

Abstract EN
The legislative authority has the power to intervene in the legislative sphere in two cases: the first is shared by the executive branch with the legislative authority in the legislative jurisdiction by giving the president of the republic the right to object On the laws and the right to issue them.
The second is where the executive authority replaces the legislative authority in drafting the legislation by granting the president the power to legislate by order.
