Abstract EN

This research discusses distributing blood money between the avengers of blood.

The study aims to explain how to divide blood money among blood avengers, state the ownership of the right of reconciliation between blood avengers, and display a collection of jurisdictional applications on how to divide blood money.

It also deals with studying how blood money is distributed between blood avengers along with mentioning the jurisdictional rulings related to issue and analyzing them.

The research concluded the agreement of Islamic jurists on the legality of retaliation in intentional slaughter if its terms are congregated.

They also agree on the legality of pardon of intentional slaughter for free, or for blood money.

In addition, they agree on the permissibility of reconciliation of retaliation in exchange for an allowance that is paid to blood avengers – this allowance may be either as much as the blood money or less.

Moreover, in case one or some of the blood avengers pardon the killer, the reconciliation money shall be distributed to blood avengers as per their legal inheritance since retaliation is an inalienable right for all heirs, one by one; therefore, if some of them reconciled for an allowance, such reconciliation shall be valid, and this shall not void other heirs’ entitlement to blood money according to rules of inheritance.
