Abstract EN

The study aimed to identify the principle of good faith in the implementation of the contract and explain many aspects related to it, as it is one of the principles that control the actions of the parties to the contract and the importance is in studying this principle because it is related to contracts that regulate interpersonal relationships, I adopted a descriptive and analytical approach to be able to analyze and discuss the texts and jurisprudential opinions.

This study reached a number of results, the most important of which is that the principle of good faith is a governing principle for the implementation of the obligation, and that the principle of good faith entails obligations for the contracting party.

The study recommends a number of recommendations, the most important of which are Stating explicitly on the requirements of good faith and the obligations deriving from it in a single theory and stipulating specific penalties in case of breach.
