Abstract EN

The study dealt with surrogacy between prohibition and permissibility.

The study aimed to address the provisions of surrogacy by determining the position of contemporary jurisprudence on this and the viewpoint of Islamic law.

The study discussed the sayings and doctrines of contemporary jurists, clarifying the evidence of these doctrines, discussing their origins, and choosing the most correct and most correct.

The study adopted the inductive and deductive approach, then the analytical approach, as I extrapolated.

It follows the opinions of the jurists on this subject, then extracts the rulings and jurisprudential trends from them, then analyzes them and weighs what is closest to the right.

The study concluded that what is meant by surrogacy is a recent picture that appeared in recent years to treat infertility, which is (a contract on the benefit of a womb with a foreign insemination for a reward).

The matter may turn into investing the woman’s body, as in some western countries.

It also concluded that the surrogacy issue entails corruption and harm on the individual, family and society levels that far outweigh the benefits and interests it achieves.

Finally, the study concluded that it is more likely to say that there is no surrogacy, whether with or without payment.

The study recommended the necessity to take into account the views of contemporary jurists and researchers on new issues such as industrial reproduction, in order to allocate schools to teach researchers how to strive and measure from the principles of jurisprudence, as well as legal rules.

And I recommend the necessity of teaching medical law in Islamic universities and issuing books and magazines that deal with the most prominent jurisprudential opinions on various modern jurisprudential issues that are accessible to students and researchers.
