This paper dealt with international humanitarian law in Islam, as the discussion of war and its provisions is in modern Islam, and this paper aimed to introduce the humanity of war in Islam - or what is called human rights towards wars, armed conflicts, or what is known today as (international humanitarian law) to legislators of positive laws and explainers.

And to show the human side of this true religion in human conditions (conditions of war), which has become falsely accused of terrorism and bloody, as the enemies of God are trying hard to affix terrorism to Islam and the importance of this paper is due to the fact that international humanitarian law in Islam derives its importance from many data, including the originality of this topic In our true religion since the dawn of Islam and the divine teachings related to the protection of war victims.

And if they are among our enemies - the significance is clear, the significance is sublime.

The importance of this paper also lies in the fact that many contemporary wars have led to thousands of victims and the emergence of many human disasters.

In this era - the era of civilization and material civilization - human rights issues have become one of the most discussed issues on the scene.

Intellectual, The paper followed the descriptive and analytical approach in its presentation of this topic, and the paper came to several conclusions, including that Islam defined the principles of international humanitarian law through the principles it laid down in relation to dealing and caring for the families and the missing, and the manner of treating non-combatants who can no longer carry weapons, elders, children, women, and property protection Civil and places of worship and vital areas of wells and orchards.

The paper recommended paying attention to the rules of Islam related to international humanitarian law, including them in legal research and teaching them, and clarifying that they existed from Islam since ancient times and were not developed in modern times, and that the application of international humanitarian law in Islam begins as soon as the war is real or a rule, and ends with the end of the war.

The international humanitarian law continues to be applied in their rights until the Muslim Imam performs his ruling.
