Abstract EN

This study aims to highlight the role of the Supreme Muslim Council (SMC) in Jerusalem (1922-1948) in preserving the waqf and public and private properties by protecting them from any sabotage.

In order to introduce this study, it tackles the factors of the emergence of the SMC after the British Mandate of Palestine and Muslims’ need to have an organized structure to run their affairs reaching the appointment of Ameen Al-Husseini as its chairman.

It seeks to preserve Islamic waqf by organizing its management and records; reclaiming its properties and supervising its real-estate and developing them.

Also, it is interested in locating the waqf lands, supervising and investing in them in favor of the Arabs.

Besides, it faces the British governments’ violations in the Muslim waqf as the one occurred in mid-1922 when some Jews have attempted to convince the owners of the lands of Ein- Karim in the Western part of Jerusalem to sell their lands.

This study has highlighted the role of Haj Abdul-Qader Al-Husseini since he has become the chairman of the SMC in 1922 as he had had a strict policy towards selling lands to Jewish companies and the various methods used to take over the Palestinian lands gradually.

In the 26th of January, 1935, a religious judgment (fatwa) issued that land-sellers, brokers and mediators of land deals are not prayed on or even buried in Muslim’s cemeteries as they should be despised.

Furthermore, a number of judges, religious men, teachers, preachers and Imams in Palestine signed it.
