Abstract EN

There is no doubt that the public administration performs various actions in order to perform its function and carry out its activities, and its work is divided into two types, material and legal works, and our study in this regard will be limited to legal actions and specifically to actions that are issued by the unilateral will of the administration (administrative decisions).

it is worth noting, in this regard, to the definition that the supreme administrative court in Egypt went to serve as the main chapter on a topic- correcting administrative decisions - when the real administration evaded what was drawn for it in issuing administrative decisions.

of its will, bound by its authority under laws and regulations, with the intent of creating a legal effect whenever it is legally possible and legal, and the motive for it is the pursuit of a public interest.

based on the foregoing, we conclude that the administration may issue a specific decision, and then it becomes clear to it the similar defect, so it tries to correct the administrative decision with a later decision.

in other words, the administration has to correct the defective decision by another decision that gives the first decision the character of legitimacy on its actions, thus correcting the decision that was marred by a waste of legal rules for the correct administrative decision.

and we explained in this study the necessity of distinguishing between administrative decisions that are tainted by a fundamental defect from the administrative decisions when the decisions are subject to correction and tainted by non-serious flaws.
