In this research, the researcher dealt with the most important topics of jurisprudence and fundamentalism, namely ijtihad by opinion, its concept and origin, its controls, and conditions, and from the evidence of ijtihad by opinion from the work of the Companions Omar Bin Al-Khattab, may God be pleased with him, who is a fundamentalist jurist and industrious.

Evidence of the number of diligence opinion in the jurisprudence of Omar bin al-Khattab.

It is of great importance for Muslims today to think about Omar Ibn Al-Khattab’s fundamentalist, intentional and ijtihad mentality in order to keep pace with the development of the contemporary world, because the principle in religion is that it is valid for every time and place.

In order to solve our contemporary problems for the correct application of the purposes of Sharia, because the principle in Sharia rulings is facilitation, the Almighty said :) God desires ease for you, and He does not desire hardship for youo (And hardship brings ease.The researcher reached a number of results and recommendations, including: that ijtihad by opinion is legitimate in the Qur’an and the Sunnah, and that ijtihad is according to the jurisprudence of Omar Ibn Al-Khattab, may God be pleased with him, and the researcher recommended to pay attention and further research on the subject.
