Abstract EN

This research aims to contribute to addressing contemporary problems and suspicions that seek to disrupt the provisions of inheritance in Islam, by exposing the shortcomings and injustices in the division of inheritance within the old and modern man-made systems and laws, and revealing the advantages, philosophy, and requirements of inheritance provisions in Islam.

The research concluded by emphasizing the superiority of our Islamic law over all other laws and regulations, given the holistic view that characterizes it; Which takes into account three dimensions in dividing the inheritance: the first: the nature and conscience of the human being, the second: the keenness to bring benefit and repel harm from people, and third: taking into account the costs entrusted to man within the family system.

On the other hand, it became clear to us through research that the rest of the ancient and modern laws and systems are characterized by partial consideration.

This is due to the predominance of the materialistic view in their division of inheritance, with their absence of emotional and emotional meanings, and what preserves the cohesion and cohesion of families.
