This article aims to clarify an important procedure that precedes the compulsory execution of the debtor's money, except the implementation presenters, which were dismissed by the legislator in the civil and administrative procedures act, after it was known as vague and ambiguous under the old civil procedure law.

he clarified when it is a general asset that cannot be implemented without taking it, and when it is considered an exception and can be executed without it, without affecting the implementation procedures.

this is done by analyzing the articles of the civil and administrative procedure code and comparing them with the comparative legislation of some states that have the same approach, so that the latter can confirm and favor the legislature clarifying this procedure in order to facilitate the work of the judicial officers and their assistants in the performance of their duties.
