Abstract EN

The preventive policy to confront the phenomenon of corruption is integral part of the criminal policy which was adopted by the Algerian legislation to limit it, on this basis it was approved for this phenomenon to intervene before the crime occurred, and declaring properties as a precautionary preventive and control mechanism developed under article 1 / 4 from law 06-01.

it aims to protect public money, accordingly, the Algerian legislator obligated every public official appointed to a lofty position or in a national assembly or a national commission or an elected member of a national assembly or nation commission to submit, forcibly or voluntarily to the obligation to declare his property whether this was at the beginning of his electoral or beginning of his appointment to his position for the first time with his obligation to return the ball to declare at the end of service period or the end of electoral term according to specific procedures and methods exclusively.

also the non compliance of public servants who are legally subject to the duty to declare properties, false, international, or incomplete statements.

this fact led the Algerian legislator impose legal effects of them.

they have legal consequences, mainly criminal liability and imposition of punitive sanctions and penal tracking because of their refusal, negligence, subject to this obligation according to the text of article 36 of law 06-01 related to preventing and combating corruption.
