The criminals extradition system is one of the most important aspect of international judicial cooperation for crime fighting; it is considered as an effective mechanism to tackle the international crime, as it should ensure that there is no impunity.

the international offenders resorts to another states to benefit from the right of asylum considering the legal protection given to them, in accordance with international treaties and especially the refugee convention ratified in 1951 however, the practical reality demonstrates many obstacles in the system of offenders extradition, committing international crimes including the matter of prohibiting extradition of political refugees, most of the countries refrain from extraditing refugees and grant them legal protection; which required major combined efforts to except the perpetrators of international political crimes from the system of prohibition on extradition, which really occurred in the declaration on territorial asylum announced by the united nations general assembly in its general session held on December 14th 1967 under n° 1631, as it excepted the political refugees from prohibiting on extradition only if they commit political crimes.
