Abstract EN

The current study content relates to the effect of some juristic issues in the contemporary trade, to reach the related private legal rules through dealing with analysis of juristic principles and their importance which is useful in the continuity of the diligence.

this meaning doesn’t explain the entity of juristic principle only, but it reveals its result and impact through deducting by these juristic principles ; thus, pointing here lies in investigating some issues related to the contemporary trade and its influence with the most important juristic principles and what has branched from them, and reach the proper legal rule.

this proves the validity of islamic legislation for each time and place, and remaining of fittings of the legal public rules for all the contemporary issues.

this study included the principle “damage is removed” and the principle “ things are subject to their purposes”, by showing the total meaning, displaying the juristic rooting of the mentioned principles and the conclusion mentioned their effect on some contemporary trade models.
